Guatemala: teacher union leader's life threatened

Joviel Acevedo has experienced many threats during his career as a union leader, but recently he was shocked to see reports in the media of his own assassination. The Guatemalan Education Workers Union (STEG) is concerned that the false news of their General Secretary's death was meant to threaten and undermine the national trade union movement.

Though the circumstances of the November 23 attack remain unclear, Acevedo confirmed he was targeted while driving his car in Teculután, district of Zapaca. He was unharmed but another car was allegedly hit by machine-gun fire, resulting in the death of an unidentified person.

These events are the latest in a history of attacks and harassment against Acevedo. They follow recent protests regarding a judicial decision to terminate his employment based on allegations that he had abandoned his post. EI has written to President Alvaro Colom deploring the 11 November ruling of the First Appeals Court for Labour and Social Security. This judgement violates ILO convention on freedom of association, of which Guatemala is signatory.

Back in 2005, the Ministry of Education launched legal action with the objective of discharging Acevedo from his teaching job on grounds that he abandoned his duties to take part in the social movement. An arrest warrant was even issued for him. STEG appealed to the Inter-American Commission of Human Rights, which recognised that Acevedo was under threat. His appeal to the Constitutional Court is still pending.

In July 2008, President Colom and Education Minister Ana Ordonez de Molina addressed the EI Latin American Committee in Guatemala City stressing that the government attaches great importance to a continuing dialogue with the teacher organisations. “One of the educational objectives of the new government is to build a culture of quality and equity,” said the Education Minister. “It is unthinkable that we would be able to carry out our education policy without the active involvement of the teachers’ organisations.”

Clearly the recent judicial decision and latest threats against Acevedo's life are not creating a climate conducive to social dialogue and trade union activities.

Excelentísimo Señor Presidente,

La Internacional de la Educación que representa a más de 35 millones de trabajadoras y trabajadores de la educación en el mundo, le expresa su preocupación por el fallo dictado el once de noviembre por la Sala Primera de la Corte de Apelaciones de Trabajo y Previsión Social en contra de Joviel Acevedo, Secretario General del Sindicato de Trabajadores de la Educación de Guatemala (STEG).

El fallo pretende la finalización de la relación laboral con causa justa del profesor Acevedo con el Estado de Guatemala a través de la entidad denominada Ministerio de Educación. Dicho fallo no considera que existe un proceso de Recurso de Amparo interpuesto por Joviel Acevedo ante la Corte de Constitucionalidad, que no ha sido resuelto y en el cual el imputado, acreditará que goza de licencia sindical para atender las actividades de su organización.

Resulta contradictorio que la Sala Primera de la Corte de Apelaciones de Trabajo y Previsión Social pretenda el término de la relación laboral entre el profesor Acevedo y el Estado de Guatemala, desconociendo su calidad de dirigente sindical, mientras su gobierno ha procedido a firmar un Pacto Colectivo con el STEG, sindicato que él dirige.

Considerando que el compañero Joviel Acevedo forma parte de la Comisión Tripartita de Derecho Internacional de Trabajo de la Organización Internacional del Trabajo y del Ministerio de Trabajo de Guatemala, el fallo mencionado no sólo es una muestra clara de persecución en contra de un dirigente sindical, sino que es violatorio de los Convenios Internacionales de la OIT relativos a los derechos de libertad sindical y negociación colectiva.

Por lo anterior, la Internacional de la Educación y sus organizaciones afiliadas en América Latina y el mundo, ven con mucha preocupación que dicho fallo tiene vicios de persecución sindical y por tal razón da lugar a la colocación de una denuncia internacional ante la Organización Internacional del Trabajo y la Corte Interamericana de Derechos Humanos.

En atención a lo anterior, y comprendiendo la independencia de los Poderes del Estado de Guatemala, la Internacional de la Educación le solicita interponga sus buenos oficios para que se garantice en su país el respeto de la libertad sindical y de las normas citadas.
